Principles of Personal Data Protection

This document contains the description of the personal data processed by our company Praguest s.r.o., having registered address at Rostovská 318/9, Praha 10 (Prague 10), company identification number: 42937710, tax identification number: CZ42937710, registered in the Companies Register maintained with the Metropolitan Court in Prague, Section C, Insert 218074, Czech Republic (hereinafter referred to as Praguest), and by Suppliers (hereinafter referred to as Companies) using our platform for business, with regard to their business partners, their representatives and employees, the purposes of personal data processing, the persons they are authorized to transfer them to and the rights you hold in relation with the processing of your personal data and their free flow, the so-called GDPR as amended.


For business cooperation resulting from the business fulfillment of the Companies and the Companies with counterparties, we use various types of personal data of our business partners (especially of suppliers and customers), their representatives and employees with whom we are in necessary contact. It is exclusively an essential extent without which the cooperation would not be feasible. In practice, it mainly refers to identification and contact details. We process the following personal data: a) identification data understood as first and last names, title, permanent address, residential address, job title held at the business partner, username and password; b) electronic and contact data, especially email address and telephone number, data box ID, IP address, identification data issued by the state, c) bank account number, d) business communication data, especially our records of the date and content of previous business communication. The processing of your personal data is essential for the realization of business cooperation. Such processing does not require your consent, since without the personal data, business cooperation would not be possible. It refers to cases regulated by the legal title (grounds) of Article 6 of GDPR. We process your personal data only for our own purposes as the Controller. We transfer the data to our third parties (especially business partners, special consultants, special administration etc.) in a limited extent only to fulfill the essentials of the business. They process them according to our instructions. We process all specified personal data as the controller. That means we define the aforementioned purposes, for which we collect your personal data, determine the means of processing and respond to their proper execution. We use your data exclusively to make, perform and settle contractual obligations (including invoicing and bookkeeping), for the purposes of marketing and fulfillment of duties resulting from legal regulations. We erase the personal data immediately upon the fulfillment of their purpose (usually business), unless the law sets forth a specific period for their retention (taxes and accounting). Marketing data requiring your revocable consent are stored for the maximum of two years. We receive the personal data from public sources, especially from the Companies Register and other public registers, from business partners or directly from you, the customers.

Personal data are only accessed by the controller and persons in a labor-law relation with the controller or processors based on a contractual relationship with the controller only for the defined purpose of processing. The controller must have a legal reason to transfer the data to another controller. The access and handling of personal data processed by the controller are subject to internal safety regulations of the controller. The controller may give access to personal data to third persons only in cases, when it is stipulated or allowed by law, otherwise only with the consent of the data subject. The processors of the personal data are the suppliers and providers of services relating with the controller´s operation.


In relation to your personal data you hold a number of rights.


  • The right to be informed and the right of access, 
  • The right to rectification, i.e. addition, 
  • The right to erasure, 
  • The right to restrict processing, 
  • The right to data portability, 
  • The right to object,
  • Right in relation to automated individual decision making and profiling with legal or similar effects.
  • File a complaint at a supervisory body


It is the right to be informed and the right of access to personal data related with the right to the first free copy in the extent of processing. As regards the right of access you especially have the right to know what data we process, for what purpose, for what period of time, where we receive your data from, to whom we transfer them, who else processes the data, storing period and what other rights you have in relation with the processing of your personal data. As per your request, we issue a confirmation regarding the type and purpose of the processed data. If you find out that the personal data processed by us are inaccurate, outdated or incomplete, you have the right to request that we correct or complete them without undue delay. In some cases you have the right to request that we erase your personal data. We will erase your personal data without undue delay based on any of the following reasons: a) we no longer need your personal data for the purposes for which we processed them; b) you exercise your right to object against the processing of your personal data based on our legitimate interest, and we assess that we no longer have such legitimate interest entitling us to process them, or c) you believe that our processing of your personal data is no longer in compliance with the general applicable legal regulations. The stated right cannot be executed in the case that the processing of your personal data is still essential for the fulfillment of our legal duties or for the determination, execution or defense of our legal titles. We must restrict the processing of personal data in cases, when: a) you deny the accuracy of the personal data until we agree on the correct data; b) our processing of your personal data lacks a legal basis; c) we no longer need your personal data for the aforementioned purposes of processing, but you require them to determine, execute or defend your legal titles, or d) you object against the processing. We are also obliged to restrict the processing of your personal data during the time of examination of the legitimacy of your objection. The right to data portability is based on the possibility of conditional receiving of your personal data provided by you to the controller in a structured, commonly used and machine-readable format; and the right to hand over such data to the controller without the previous controller´s resistance. The data subject also has the right to request that the controller hands over the data subject´s personal data to another controller in a structured, commonly used and machine-readable format, if technically possible.

Based on their specific situation, the data subjects have the right to object any time against the processing of personal data that are processed based on legal reasons:

  1. The processing is essential for the fulfillment of tasks performed in the public interest or during the performance of state power assigned to the controller,
  2. The processing is essential for the purposes of legitimate interests of the relevant controller or the third party.

The personal data controller no longer processes the data, unless there are provable legitimate reasons for the processing prevailing over the interests or rights and freedoms of the data subject, or for the determination, exercise or defense of legal titles. Also the processing of personal data for the purposes of direct marketing or profiling may be objected. Should the data subject object against the processing for marketing purposes, personal data will no longer be processed for those purposes. The filing of the objection will be assessed immediately and followed by a report. The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning him or her or has similar significant effects on him or her (Article 22 GDPR). The data subject has the right to file a complaint at a supervisory body, if he or she believes that the processing of his or her personal data breaches his or her right, whereas the supervisory body in the Czech Republic is the Office for Personal Data Protection.


In cases, when the processing of personal data requires your consent, you may revoke the given consent any time in writing or by email. The consent is required for sending business notifications (apart from newsletters referring to similar goods or services purchased at the entrepreneur by the customer), for giving references on the websites (if they contain personal data – e.g. first name, last name and email or photograph) or when the entrepreneur wants to track the customer´s position.

We hereby declare that we have adopted all adequate and currently known technical and organizational security steps using modern technologies in order to protect your personal data against abuse, damage or destruction as if they were of our own. We take the same care to secure data storages and personal data storages in a printed form. Personal data are accessible only by authorized persons. All our employees that have access to your personal data are obligated to remain confidential and are trained in the area of security of personal data processing. The obligation of confidentiality persists even after the termination of contractual relations with us.

By sending the order, you confirm that you have been acquainted with the conditions for the protection of personal data and that you accept them in full. We have the right to alter these conditions. To exercise the aforementioned rights, each data subject may refer to the controller by sending an email to  or in writing to the Praguest´s address.

Business Terms and Conditions

Business Terms and Conditions (“BTC”)
For suppliers selling electronic vouchers (hereinafter referred to as “EV”) via portal owned and operated by company Praguest s.r.o., having registered address at Rostovská 318/9, Praha 10 (Prague 10), company identification number: 42937710, tax identification number: CZ42937710, registered in the Companies Register maintained with the Metropolitan Court in Prague, Section C, Insert 218074, Czech Republic (hereinafter referred to as “Praguest”).

I. Rules and Conditions.

1) Company Praguest advertises offers for products under its conditions displayed on its web For those interested, it subsequently arranges the sale of electronic vouchers (hereinafter also referred to as “EV”) of a definite monetary value that can be used for paying for services, purchasing of certain goods, or for other practical purposes related to them, that are provided to Customers by a Supplier. It is directly the Supplier who enters into a specific contract to purchase EV with an arranged Customer according to the attached Business Terms and Conditions included of the Personal Data Protection principles (hereinafter referred to as “documents”) accepted by the Customer via an online platform on These documents also apply to the selling of Supplier´s Vouchers to all legal entities and natural persons ordering the Voucher. By placing an order, the Customer declares to have been acquainted with the documents in detail. Each EV purchase is related with clicking on the “Agree” button. It is necessary for the deal to be made. These documents constitute an integral part of the executed contract entered into by a Customer with a Supplier by means of a form placed on the web After that, the Customer fills in an order (included of the acceptation of price and method of payment), stating the true and specific data, and receives a confirmation from the Supplier (the contract is, this way, executed), and after payment, the Customer is emailed the Electronic Voucher and the instructions for gaining access to the product. They also receive an invoice.

2) Praguest is not the Supplier of the performance paid with EV. The Supplier is understood as the provider who is fully responsible for the proper performance under EV and for all matters connected with it, including, but not limited to, the provision of a guarantee, service and product liability or other performances, and directly handles complaints, is fully liable for damage and loss and any liabilities and claims under the executed contract.

3) By placing an order by means of a webpage, a person confirms the following:
a) To have legal capacity to enter into binding contracts; and
b) To be at least 18 years of age; and
c) To grant us an irrevocable and non-exclusive license to use any content disclosed by the person on the website, or otherwise revealed to us by means of any media and for any purposes.
d) To agree with the personal data protection principles relating with personal data provided to us upon the purchase of the Voucher (namely the person´s name, address, email address, telephone number etc.), and with the processing of your personal data by checking a relevant box.

II. Payment for EV.

Customers may select the payment method. If they select a bank transfer, payment instructions will be displayed on the monitor (receiver, amount, due date, account number in form of IBAN including SWFIT, and payment identifier). For international transfers, Customers are obliged to select “OUR”, i.e. “Remitter pays all fees” or “Sender bears all transaction fees”, as the method of charged transaction fees.
In the case of a bank transfer payment for an EV, the payment identifier is the order number. A customer pays the purchase price for EV to the specified bank account.

The price is considered as paid in the moment when the entire relevant amount is credited to the account of Praguest´s cash collection payment gateway. For each payment, the Supplier issues an invoice containing the elements of a tax document according to legislation. In case a Customer pays the price via an international bank transfer or otherwise, whereas additional fees may be charged, they bear all fees. The customer is obliged to add the fees to the sent amount so that the Supplier receives the amount in full. 

III. Application of EV.

As is stated above, EV ordered online may include a specific content. EV, always issued by the Supplier, is a card containing a unique code of a stated value and a validity date authorizing its holder to be provided the contained performance up to the full use of its value. 

EV is marked with a validity date. With the expiry of the validity date, all rights related with it are extinguished, too. The EV validity cannot be extended. When applying an EV, a Customer is obliged to present it to the Supplier. 

EV may only be applied once; application cannot be divided. The purchase value must be the same or higher than the EV value. Should the value of the goods or a service be lower than the EV value, the difference is not returned. Should the value of the goods or a service be higher than the EV value, the difference must be placed on spot. The EV value is not charged with interests. An EV cannot be exchanged for money. In the case of loss, EP cannot be substituted. A receipt of its payment cannot be accepted as a substitution. It is strictly forbidden and against the law of the Czech Republic to counterfeit or alter an EV. Alternative performance is not provided. The Voucher code must be protected. The Supplier or Praguest bear no responsibility for the loss of an EV or alienated codes. 

If the EV application requires reservation, an exclusive code is used, by means of which a Customer (or a person to which it was assigned) subsequently reserves EV drawing for a specific date and person (persons) on the Supplier´s website or email. The date is arranged by a Supplier´s confirmation sent to an email specified in the order. Change of date without the Supplier´s confirmation is not possible. The confirmation email includes the advance date (specific date) by which the use of EV must be reserved. So the voucher may also be used by third persons, to which it has been assigned, whereas by the assignment they agree with the conditions of the contract and the business terms and conditions. Prior to the assignment (usually by donation), the Customer has the obligation to inform the recipients of the gift of the content of the contract and the documents relating with EV. Should the persons drawing the EV fail to appear on time reserved, their claim to the drawing is extinguished (unless agreed otherwise with the Supplier on spot). Prior to the drawing of the EV, the Customer must prove to the Supplier their eligibility for the purchase of the services or goods either by presenting the printed EV (received sooner from the Supplier in form of a .pdf file) or by displaying the Voucher on an electronic device monitor (smartphone, tablet etc.).

IV. Withdrawal from the Contract by the Consumer.

The consumer is a natural person acting outside their business activities or within a separate profession. As a Customer, the Consumer has the right to withdraw from the Contract executed via the Internet, email, telephone or other means of distant communication within 14 days from the execution of the contract. The stated period commences on the day of online delivery of EV. To keep it, it is enough to send a notice of withdrawal prior to the expiry of the deadline. The Customer may do so by means of a form attached to these Business Terms and Conditions. Within 14 days, Praguest arranging the payments for the Vouchers returns the amount corresponding to the paid price to the Customer in the same way, in which the payment was received from the Customer. When the withdrawal from the Contract comes into effect, the Voucher will be invalidated by the Supplier.

V. Complaints.

  1. The Supplier is obliged to provide the Customer with performance according to the executed contract, these Business Terms and Conditions and the general applicable laws of regulations. 
  2. Should the Supplier fail to fulfill their obligations under the Contract duly and timely, the Customer is obliged to complain to the Supplier about the defects without undue delay, however no later than within 14 calendar days from delivery. In the complaint, the Customer is obliged to describe the defects and specify the code. The Supplier handles the complaint without undue delay, however no later than within 30 days from the day of its proper filing. In case the complaint is rejected, the service provider issues a written reasoning to the Customer (whereas for the purposes of the complaint procedure, a written form is understood as an email, too). In the case of a duly filed and a reasonable complaint, the Customer has the right to the removal of the defect, and if it is not possible, the Customer has the right to an adequate discount from the price, or to withdraw from the contract. If the conditions for withdrawal of the contract are laid on the grounds given by the Supplier, the Customer has the right to the reimbursement of the paid price.

VI. Final Provisions.

1) The websites are the exclusive property of Praguest. It is strictly forbidden to duplicate, distribute, transfer, disclose, give links or make other adjustments to the websites without the explicit written consent of Praguest. Any breach of this provision may result in the infringement of copyright, trademark or other intellectual property rights, which may expose you to civil and other recourse.

2) The Customer agrees with sending information from the Supplier relating with products to their electronic address, and they further agree with sending business notifications from the Provider and Supplier to their electronic address. The Customer agrees with saving of the so-called cookies to their computer. When browsing our website, we record your IP address, the actual version of your browser and operating system, the time spent on our website and the information about what webpage you came from. We perceive using cookies to measure the visiting rate of our web and the adaptation of displaying the website as our legitimate interest as an administrator, since we believe that based on that we can offer even better service. Cookies for advertisement directing will be processed only based on your consent. Our website can also be browsed in a mode in which personal data are not collected. You may disagree with using cookies on your computer on the Internet browser.

3)The Business Terms and Conditions are issued in the Czech and English languages. The rights and obligations of the contracting parties are subject to the law of the Czech Republic and in the case of any disputes, which the contracting parties agrees to preferentially settle amicably, Czech jurisdiction applies regardless of any possible international elements in the executed contract. Any disputes will always be decided by courts having subject-matter and venue jurisdiction in the Czech Republic. The rights and obligations not explicitly regulated herein are subject to the Czech Civil Code.

Podmínky používání webových stránek

Vlastníkem a provozovatelem internetových stránek je společnost Praguest s.r.o., která je v souladu s platným českým autorským zákonem oprávněna vykonávat majetková práva k těmto internetovým stránkám (dále jen „Provozovatel“). Provozovateli náleží všechna autorská práva k veškerému obsahu, který Provozovatel umísťuje na stránkách (dále také stránky) včetně textu, grafiky, designu stránek, všech umísťovaných vyobrazení, technických řešení, jakož i k výběru a způsobu uspořádání souborů obsažených na těchto stránkách. Dále uvedená pravidla stanoví práva a povinnosti Provozovatele a uživatelů při používání těchto stránek a vztahují na všechny osoby, které navštíví tyto stránky (dále jen Uživatelé). Uživatel vyjádří souhlas s těmito Pravidly tím, že vstoupí na kteroukoliv ze stránek Provozovatele či jakýmkoliv způsobem užije jakoukoliv informaci umístěnou v rámci www stránek Provozovatele. Můžete si stáhnout jednu kopii informací nacházejících se na webových stránkách společnosti do jediného počítače pouze pro vaše osobní, nekomerční a interní použití. Souhlasíte s tím, že nebudete používat internetové stránky, zejména pak jakékoli materiály či služby, které můžete získat jejich užitím, způsobem, který porušuje jakýkoli právní předpis. Provozovatel nenese žádnou odpovědnost za jakékoliv případné škody, které uživatelům mohou vzniknout v souvislosti s používáním internetových stránek Provozovatel také nenese žádnou odpovědnost za reklamu, popř. jinou formu propagace prováděnou jakýmkoliv třetím subjektem prostřednictvím stránek Provozovatel dále nenese žádnou odpovědnost za obsah www stránek patřících třetím subjektům, které lze navštívit prostřednictvím stránek Přístup na stránky nebo některé služby poskytované Provozovatelem na těchto internetových stránkách mohou být úplně či částečně podmíněny poskytnutím některých osobních údajů uživatele ve smyslu platného zákona o ochraně osobních údajů. Přístupem dáváte souhlas s užitím a zpracováním osobních údajů ke sledovanému účelu. Provozovatel se zavazuje s těmito údaji nakládat v souladu s platnými právními předpisy a užívat je pouze v rozsahu nezbytném pro naplnění účelu, pro který jsou tyto údaje získávány a vždy tak, aby zamezil jakékoliv újmě subjektu těchto údajů. Jako většina internetových stránek, i stránky Provozovatele používají cookies. Jde o malé datové soubory uložené ve vašem počítači nebo v jiném počítači pro použití se softwarem vašeho webového prohlížeče. Cookies poskytují Uživateli přístup k funkcím jako je například získávání informačních materiálů, které jsou k dispozici na těchto webových stránkách. Na základě anonymních datových objektů například Provozovatel sleduje celkový počet návštěvníků na těchto stránkách. Přijetím těchto podmínek užívání a také přístupem a používáním těchto webových stránek souhlasíte s používáním výše zmiňovaných cookies. S používáním cookies můžete také souhlasit nastavením, které provedete ve vašem webovém prohlížeči. Pokud si nepřejete přijmout používání cookies, musíte z těchto webových stránek odejít nebo vypnout funkci pro cookies v nastavení vašeho webového prohlížeče. Vezměte prosím na vědomí, že bez cookies může být funkčnost webových stránek narušena. Obsah internetových stránek má pouze informativní a nezávazný charakter. Provozovatel neručí za správnost a úplnost informací na těchto internetových stránkách. Zveřejnění jakýchkoliv údajů a informací na těchto stránkách, s výjimkou těchto podmínek, nemá povahu žádného právního úkonu směřujícího ke vzniku právního vztahu mezi Provozovatelem a Uživatelem, pokud nebude v jednotlivých případech výslovně uveden jinak. Veškeré spory vzniklé v souvislosti s využíváním těchto stránek, se řídí právem České republiky a její jurisdikci.
